Terms of Use

These Terms of Use ("Terms") govern your use of H2O, a water tracking app for iPhone and Apple Watch provided by Lunarbits ("we," "us," or "our"). By downloading or using H2O, you agree to these Terms. If you do not agree, please do not use the app.

1. License to Use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use H2O for your own personal, non-commercial purposes, subject to these Terms and the App Store Terms of Service. You may not copy, modify, reverse engineer, redistribute, or create derivative works from the app except as permitted by law.

2. Not Medical Advice

Always use your own judgment and consult a qualified healthcare professional regarding your hydration needs, especially if you have a medical condition, are pregnant, or take medication. Do not rely on H2O as a substitute for professional medical advice, and never disregard professional advice because of something in the app.

3. Purchases and Subscriptions

H2O may offer optional in-app purchases or subscriptions. All payments are processed by Apple through the App Store and are subject to Apple's Media Services Terms. If you purchase an auto-renewing subscription, it will automatically renew unless you cancel at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID account settings. Except where required by law, payments are non-refundable; refund requests are handled by Apple.

4. Acceptable Use

You agree not to misuse the app, interfere with its normal operation, attempt to gain unauthorized access to any systems, or use the app in violation of any applicable law. You are responsible for your device and for keeping your Apple ID secure.

5. Intellectual Property

H2O, including its name, design, interface, graphics, and underlying software, is owned by Lunarbits and protected by intellectual property laws. These Terms do not grant you any right to our trademarks, logos, or branding. All rights not expressly granted are reserved.

6. Third-Party Services

H2O relies on services provided by Apple, including Apple Health (HealthKit) and iCloud (CloudKit). Your use of those features is also subject to Apple's terms and privacy policies. We are not responsible for the availability or performance of third-party services.

7. Disclaimer of Warranties

H2O is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that data will always be preserved. You are responsible for maintaining backups of important data.

8. Limitation of Liability

To the maximum extent permitted by law, Lunarbits shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) H2O. To the extent liability cannot be excluded, our total liability shall not exceed the amount you paid for the app in the twelve months preceding the claim, or, if the app was free, USD $50.

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of H2O after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of New York and the United States, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in New York. Nothing in these Terms limits any consumer-protection rights you may have under the laws of your country of residence.
